The Third Criminal Chamber of the Tripoli Court of Appeals ruled on Monday, to acquit leaders of the former regime of the charge of suppressing protesters during the February 17, 2011 revolution, in case No. (630_2014).
This decision was reached after reviewing the case files, hearing oral arguments, and deliberating in accordance with Articles 275, 276, 277(1), 345, and 348 of the Code of Criminal Procedure and Article 105 of the Penal Code.
The verdict was issued under the Presiding Judge, Ramadan Ali Balout, with the membership of Judge Samia Ibrahim Al-Talib, Judge Mustafa Al-Maqtouf Ashina, Public Prosecution representative Milad Radwan, and Court Clerk Ali Lamtanani, according to what the court published on its Facebook page.
Verdict on Leaders of the Former Regime
The court first ruled in the presence of the second defendant (Abdullah Muhammad Imhamed al-Senussi), the third (al-Baghdadi Ali Ahmad al-Mahmoudi), the fourth (Mansour Daou Ibrahim Mansour) the seventh (Mohamed Abou-El-Qasim Youssef Al-Zawi), the eighth (Mohamed Ahmed Mansour Al-Sharif), the ninth (Hosni Al-Wahishi Al-Sadiq Al-Kabir), the tenth (Munther Mokhtar Ramadan Al-Ghoneimi), the twelfth (Amer Ali Faraj Al-Daliou), the thirteenth (Radwan Al-Hadi Ali Al-Hamali), the fifteenth (Abdulhamid Ammar Ouhida), the sixteenth (Jibril Abdulkarim Al-Kadiki), the eighteenth (Mohammed Boubaker Ali Al-Deeb), the nineteenth (Al-Mabrouk Mohammed Al-Mabrouk Masoud), the twentieth (Abdulmajeed Salem Faraj Al-Mazougi), the twenty-first (Omran Mohammed Omran Al-Farjani), the twenty-fifth (Abdullah Abu al-Qasim Abdullah al-Sha’lali), the twenty-ninth (Said Ibrahim Abdullah al-Gharyani), the thirtieth (Mohammed Ahmed Dhaw al-Hanashi), the thirty-first (Ouidat Ghandour Abu Sufah), the thirty-sixth (Ali Abd al-Salam al-Layd), and the thirty-eighth (Abdulraouf Masoud Al-Awar).
Second: In absentia for each of the defendants: the sixth (Milad Salem Milad Daman), the twenty-second (Ali al-Maqtuf Khalifa al-Zawi), the twenty-fourth (Jamal Ali Ahmida al-Shahid), the twenty-sixth (Mohsen al-Hadi Muhammad al-Lamouji), the twenty-seventh (Mohammed Khalifa Mohammed Al-Wa’er), the twenty-eighth (Abu Ajila Mohammed Khair Masoud), the thirty-third (Amer Ali Madi Al-Abani), the thirty-fourth (Mohammed Ramadan Abdullah Ashteba), the thirty-fifth (Abdulrahman Abdulsalam Al-Qamati), and the thirty-seventh (Khalid Muhammad Muhammad Abayeg) “of the charges attributed to them.”
Dismissal of charges against leaders of the former regime due to death
The court also acquitted the first defendant (Saif al-Islam Muammar Muhammad Gaddafi), the fifth (Abu Zeid Omar Ahmed Dorda), the eleventh (Abdulhafiz Mahmoud Ahmed al-Zlitni), the fourteenth (Bashir Ali Muftah Hamidan), the seventeenth (Abdul-Ati Ibrahim Muhammad Hamid), the twenty-third (Nuri al-Hadi al-Tahir al-Jatlawi), and the thirty-second (Ammar al-Mabrouk Muhammad al-Naid) “due to the dismissal of the charges following the defendants’ deaths prior to conviction.”
